{"id":11815,"date":"2025-10-23T14:05:18","date_gmt":"2025-10-23T13:05:18","guid":{"rendered":"https:\/\/seecheck.org\/?p=11815"},"modified":"2025-11-06T14:26:48","modified_gmt":"2025-11-06T13:26:48","slug":"the-council-of-the-european-union-did-not-adopt-a-ban-on-the-transit-of-russian-gas-through-the-eu-to-third-countries","status":"publish","type":"post","link":"https:\/\/seecheck.org\/index.php\/2025\/10\/23\/the-council-of-the-european-union-did-not-adopt-a-ban-on-the-transit-of-russian-gas-through-the-eu-to-third-countries\/","title":{"rendered":"The Council of the European Union Did Not Adopt a \u201cBan on the Transit of Russian Gas Through the EU to Third Countries\u201d"},"content":{"rendered":"\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><a href=\"https:\/\/fakenews.rs\/2025\/10\/22\/zabrana-tranzita-ruskog-gasa\/\"><em>Original article<\/em><\/a><em> (in Serbian) was published on 22\/10\/2025; Author: Teodora Koledin<\/em><\/p>\n<\/blockquote>\n\n\n\n<p><em>A large number of media outlets have reported that the Council of the European Union adopted a ban on the transit of Russian gas through EU territory to third countries \u2013\u00a0a claim also <a href=\"https:\/\/archive.ph\/ZScZb\">echoed <\/a>by Serbia\u2019s Minister of Mining and Energy, <strong>Dubravka \u0110edovi\u0107 Handanovi\u0107<\/strong>, who described the situation as \u201cvery difficult and almost hopeless.\u201d However, an EU Council official, in a response to Traga\u010d, clarified that the \u201c<strong>phased reduction and ban outlined in the Council\u2019s position do not apply to transit procedures<\/strong>.\u201d<\/em><\/p>\n\n\n\n<p>We first carefully reviewed the <a href=\"https:\/\/archive.ph\/7Ime3\">text <\/a>of the <em>Proposal for a Regulation of the European Parliament and of the Council on the gradual phase-out of Russian gas imports<\/em>, but found <strong>no evidence<\/strong> to support the claim made in the media. Specifically, in May 2022, the European Commission launched the <em>REpowerEU<\/em> plan to \u201ccompletely diversify away from Russian energy imports in a secure, affordable, and sustainable way.\u201d Later, on May 6 of this year, the Commission announced the <em>Plan for the Complete Phase-Out of Russian Energy Imports<\/em>.<\/p>\n\n\n\n<p>The proposed regulation stipulates that, starting January 1, 2026, the import of Russian gas will be prohibited under new contracts concluded after June 17, 2025, while short-term existing contracts may continue until June 17, 2026. At the same time, by the end of 2027, \u201ca complete cessation of imports under existing contracts\u201d is planned, with a gradual phase-out of remaining gas quantities. Naturally, these provisions apply to EU member states, which are required to develop national diversification plans.<\/p>\n\n\n\n<p>In a <a href=\"https:\/\/archive.ph\/U43Mh#selection-1901.0-1908.0\">statement <\/a>issued lately, the Council of the European Union noted that \u201cadditional monitoring and reporting mechanisms have also been introduced to prevent the entry of Russian gas into the EU through transit procedures (i.e., gas that passes through the EU on its way to another destination without entering the EU market).\u201d<\/p>\n\n\n\n<p>We asked whether this plan indeed includes a \u201cban on the transit of Russian gas,\u201d as claimed by Minister \u0110edovi\u0107 Handanovi\u0107, and soon received a response from an EU Council official:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe phased reduction and ban outlined in the Council\u2019s position do not apply to transit procedures (that is, gas originating in a third country and passing through EU territory to another third country without entering the EU market). There are only additional monitoring and reporting mechanisms to prevent possible leakage of Russian gas within such transit procedures.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>In short, Russian gas can still pass through EU territory on its way to a third country (under increased supervision), but it must not enter the EU market along the way.
